This Privacy Policy explains how Polares Medical SA and its affiliates (“Polares Medical,” “we,” “us,” or “our”) collect, use, disclose, and protect information in connection with the website polaresmedical.com (the “Website”). It applies to all visitors and users of the Website. Please read it carefully to understand our practices regarding your information.

Because Polares Medical operates in both the United States and Switzerland and may receive inquiries from around the world, this Policy is designed to meet the requirements of the Swiss Federal Act on Data Protection (FADP), and the EU and UK General Data Protection Regulation (GDPR). Where a particular law grants you rights, those rights are described in Section 9.

Important: Polares Medical is a medical device company. The Website is an informational and corporate site. It is not intended to provide medical advice, to diagnose or treat any condition, or to collect health information from patients. Nothing on the Website should be relied upon as a substitute for advice from a qualified healthcare professional.

1. Scope of This Policy

This Policy covers information collected through the Website. It does not cover information you provide to us offline, through clinical trials, through third-party platforms we do not control, or in the course of business relationships governed by separate agreements. These processing activities are covered by separate privacy policies which we will make available to you at the appropriate time. Where a separate notice or agreement applies to a specific interaction, that notice or agreement governs to the extent it conflicts with this Policy.

2. Information We Collect

2.1 Information You Provide Voluntarily

We collect information you choose to submit through our contact form or by otherwise communicating with us. Our contact form requests the following:

  • Name (first and last)
  • Company
  • Email address
  • Your area of interest (for example: Supplier or OEM, Research, Media, Employment, or Other)
  • The content of your message

You are not required to provide this information to browse the Website, but we need it to respond to inquiries you submit. Please do not include sensitive personal information, including any health or medical information, in messages you send through the Website.

2.2 Information Collected Automatically

When you visit the Website, certain information is collected automatically by our hosting provider, security services, and analytics tools. This may include your IP address, browser type and version, operating system, referring and exit pages, pages viewed, the dates and times of access, and similar diagnostic and usage data. 4.1 Consent Management

  • Other regions: the Website loads normally with the option to manage cookie preferences.

5. Third-Party Services and Service Providers

We rely on the following third-party platforms and services to operate the Website. Each processes information in accordance with its own privacy policy, which we encourage you to review. Certain of these third parties (including without limitation third-party analytics service providers and commercial partners) may directly collect information about our users’ online activities over time and across different websites.

5.1 WordPress Software

The Website is built using the open-source WordPress software (WordPress.org), which provides the content management system for our site. The WordPress software itself does not transmit visitor data to WordPress.org. More information is available at wordpress.org/about/privacy.

5.2 Pressable – Hosting

The Website is hosted by Pressable, a managed WordPress hosting provider. When you visit the Website, Pressable may collect standard server and log data – such as your IP address, browser type, operating system, referring pages, and access times – for the purpose of delivering, maintaining, and securing the hosting environment. Pressable’s handling of this information is governed by its privacy policy, available at pressable.com/legal/privacy-policy.

5.3 Jetpack and Related Automattic Services

We use Jetpack, a plugin developed by Automattic, for security, performance, and site statistics. Jetpack may collect information such as IP addresses, browser and device information, pages viewed, and related usage data to provide these features. The Website also uses the Automattic for Agencies client, which supports management of the site by our agency. Automattic’s handling of this data is governed by its privacy policy, available at automattic.com/privacy.

5.4 Akismet – Spam Protection

We use Akismet, an anti-spam service provided by Automattic, to detect and filter spam submitted through forms on the Website. When you submit a form, information such as your IP address, browser user agent, the content submitted, and related metadata may be sent to Akismet for spam evaluation. This processing is governed by Automattic’s privacy policy, available at automattic.com/privacy.

5.5 Gravity Forms – Contact Form

Our contact form is powered by Gravity Forms. When you submit the form, the information you provide is processed and stored so that we can receive and respond to your message. This data may be retained in the Website’s database and transmitted to us by email. Gravity Forms is a self-hosted plugin; the form data it processes is held within our own hosting environment rather than sent to Gravity Forms as a company. 5.6 Blocksy Theme (Blocksy Companion)

The Website’s design is built on the Blocksy theme and its companion plugin, developed by CreativeThemes. These provide the visual framework and front-end functionality of the site. More information is available at creativethemes.com/blocksy/privacy-policy.

5.7 WP Before After Image Slider

We use the WP Before After Image Slider plugin (by Code Canel) to display interactive before-and-after visual content. This plugin renders media within the Website and does not, in ordinary use, collect personal information from visitors. More information about the developer is available at codecanel.com.

5.8 Google Analytics

We use Google Analytics 4, a web analytics service provided by Google, to understand how visitors use the Website and to help us improve it. Google Analytics uses cookies and similar technologies to collect information such as your IP address (which Google shortens/anonymizes), device and browser type, pages viewed, and interactions with the Website. In regions where consent is required, Google Analytics is loaded only after you consent through our consent management tool (see Section 4). Google processes this data in accordance with its own privacy policy, and Google may act as an independent data processor and, in some contexts, share data across its services. 5.9 Embedded and Third-Party Content

Pages on the Website may include embedded content such as videos or images. Embedded content from other websites behaves as though you visited that other website directly, and those sites may collect data about you, set cookies, and monitor your interaction with the embedded content. We do not control the privacy practices of third-party sites and encourage you to review their policies.

6. How We Disclose Information

We do not sell your personal information for money. We use Google Analytics as described in Section 5.8; because the disclosure of online-identifier and usage data to an analytics provider. We may otherwise disclose information in the following limited circumstances:

  • Service providers: with the third-party providers described in Section 5, who process information on our behalf to operate the Website.
  • Within our organization: among Polares Medical and its affiliates in the United States and Switzerland, for the purposes described in this Policy.
  • Authorities: We may disclose personal data to offices, courts and other authorities locally and abroad if we are legally obliged or entitled to do so or if this appears necessary to protect our interests. The recipients process the data under their own responsibility.
  • Parties to corporate transactions: in connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction to potential or actual acquirers, other transaction partners, and their professional advisors.
  • Professional advisors: We may provide your information to professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.

7. International Data Transfers

Polares Medical operates in both Switzerland and the United States, and our service providers may process information in various countries. As a result, your information may be transferred to, stored in, and processed in countries other than the one in which you reside, including the United States and potentially in any country in the world.

If a recipient is located in a country without adequate statutory data protection, we require the recipient to undertake to comply with data protection (for this purpose, we use the revised standard contractual clauses of the European Commission, which can be accessed via https://eurlex.europa.eu/eli/dec_impl/2021/914/oj, if necessary with the required adaptations for Switzerland),
unless the recipient is subject to a legally accepted set of rules to ensure data protection. We may also disclose personal data to a country without adequate statutory data protection without entering into a separate contract for this purpose if we can rely on a legal derogation. A derogation may apply in particular in the case of legal proceedings abroad, but also in cases of overriding public interests or if the performance of a contract that is in your interest requires such disclosure (e.g., if we disclose data to our
correspondent law firms), if you have consented, if it is not possible to obtain your consent within a reasonable period of time and the disclosure is necessary to protect your life or physical integrity or that of a third party, or if it concerns data made publicly available by you, the processing of which you have not objected to. We may also rely on the exception for data from a register provided for by law (e.g., commercial register) to which we have been legitimately granted access.

8. Data Retention

We retain information submitted through the contact form for as long as necessary to respond to your inquiry, to maintain a record of our correspondence, and to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Automatically collected log and analytics data is retained in accordance with the practices of our hosting, security, and analytics providers. When information is no longer needed, we take reasonable steps to delete or anonymize it.

Depending on where you live, you may have some or all of the following rights regarding your personal information. To exercise any of these rights, contact us using the details in Section 12; we will respond within the timeframe required by applicable law and may need to verify your identity before acting.

If you are in the European Economic Area, the United Kingdom, or Switzerland, you may have the right to access the personal information we process about you; to correct inaccurate information; to request erasure; to restrict or object to certain processing; to data portability; and, where processing is based on consent, to withdraw that consent at any time without affecting prior processing. You also have the right to lodge a complaint with your local supervisory authority — in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC); in the EEA or UK, your national data protection authority.

Please note that conditions, exceptions, or limitations apply to these rights (e.g., to protect third parties or trade secrets or due to our professional obligation of confidentiality). We reserve the right to redact copies or to supply only excerpts for reasons of data protection or confidentiality.

9.2 Other Jurisdictions

Residents of other regions may have similar rights under applicable local law. We will honor those rights to the extent required. Note that some information may be retained where we have a legal obligation or legitimate business reason to keep it.

10. Security

We use reasonable technical and organizational measures designed to protect information against unauthorized access, loss, misuse, or alteration. This includes access restrictions on our staging and production environments and secure handling of credentials. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You submit information at your own risk.

11. Children’s Privacy

The Website is intended for a professional and general adult audience and is not directed to children under the age of 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so that we can take appropriate action.

14. Do Not Track


The term “Do Not Track” refers to a HTTP header offered by certain web browsers to request that websites refrain from tracking the user.
